DHAKA: The High Court cleared the way for newly appointed Prof Fouzia to join as Viqarunnisa Noon School and College (VNSC) as its principal.
The HC bench of justice M Enayetur Rahim and Md Khairul Alam on Tuesday (September 17) passed the order after hearing a writ petition filed challenging the legality of the appointment of Prof Fouzia.
The court also issued a rule asking the government to explain in four weeks why the appointment of Prof Fouzia should not be declared illegal.
However, the court did not issue any interim stay order on the notification of her appointment. As a result, there is no bar to her joining as the Principal, Attorney General Mahbubey Alam said.
Earlier on September 16, an appeal was filed with the High Court challenging legality of Directorate of Secondary and Higher Education (DSHE) official Fouzia as Viqarunnisa Noon School and College principal.
The plea filed by the institution's former governing body member also Supreme Court lawyer Eunus Ali Akond, also sought a rule on questioning why the appointment won't be declared illegal, and a stay on the gazette notification.
He reasoned "abusing government power" to appoint the DSHE official as Viqarunnisa head.
Moreover, a status-quo on Fouzia's activities also has been sought to be imposed.
The HC bench of Justice M Enayetur Rahim and Justice Md Khairul Alam heard the plea Monday (September 16) and kept the order pending for Tuesday (September 17).
Secondary and Higher Education Department of Education Ministry issued a notification on Sunday (September 15) appointing Fouzia as the principal of Viqarunnisa Noon School and College.
