DHAKA: The Appellate Division of Supreme Court (SC) permitted the doctors to appeal against the High Court (HC) ruling that termed their appointment at Bangabandhu Sheikh Mujib Medical University (BSMMU) illegal.
The 111 doctors got appointed during BNP-led government’s tenure.
A bench headed by chief justice passed the order on Sunday (September 04) asking to submit the summery of their appeal within four weeks.
Dr. Kamal Hossain, Rokan Uddin Mahmud and Kamrul Hoque Siddique stood for the doctors and attorney general Mahbub-e-Alam for the university authorities.
Swadhinata Chikitsak Parishad president Professor Dr M Iqbal Arsalan submitted a writ petition to HC claiming the doctors’ appointments, in response to a job circular published on October 18 in 2005 by BSMMU, were illegal.
Against the writ, the HC stopped the job process on January 2, 2006 besides issuing a rule.
After final hearing on December 14, 2010, HC declared the doctors’ appointments illegal.
Physician Khairun Nahar along with others filed leave to appeal against the court ruling, though the Appellate Division dismissed the petition on February 22 this year.
The physicians then pleaded for a review against the Appellate Division’s decision.
