DHAKA: The Supreme Court Monday upheld the High Court`s order granting bail to former State Minister for Education Ehsanul Haque Milon in an extortion case filed in Chandpur, as the government move for a stay didn’t stand.
“There is no bar to his release from jail following the order confirming his bail,” his counsel said.
Justice ABM Khairul Haque, the Chamber Judge, rejected the petition filed by the government seeking stay on the HC order.
The case was filed against the BNP leader with District Session Judge’s Court, Chandpur, in 2010 on charge of extortion in 2000.
A bench of Justice Syed Dostagir Hossain and Justice Jahirul Haq on August 16 granted interim bail for three months to Milon in the case.
Milon’s lawyer, Barrister Mahbub Uddin Khokon, said there is no bar to his client’s release from jail “if any new case is not filed again against him”.
Additional Attorney-General Momtaz Uddin Fakir stood for the state and lost the legal battle.
